Terms and Conditions for Retailers and Clients

This unified section applies to both Retailers and Clients using our Loyalty Reward Platform. Where applicable, specific clauses refer to the user type.

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of our Loyalty Reward Platform ("Platform"), provided by Gamma ("we," "us," or "our"). The Platform includes mobile and web-based applications designed for Retailers and Clients across the European Union (EU). By using the Platform, you confirm that you have read, understood, and agreed to these Terms and to compliance with all relevant EU laws and regulations.

2. Definitions

  • Retailer: A registered business entity or individual using the Retailer App to manage customer rewards.
  • Client: An individual using the Client App to receive and redeem rewards from participating Retailers.
  • Reward Contract: A digital promise between a Retailer and a Client to provide future redeemable value based on prior engagement.
  • Platform: The entire digital infrastructure encompassing the Retailer App, Client App, and back-end services.

3. Account Eligibility

  • Retailers: Must be legally registered within the EU and authorized to process reward programs.
  • Clients: Must be at least 16 years old, or older where required by their local jurisdiction, with parental consent if under 18.

4. Platform Functionality

Retailers can:

  • Create and manage reward pools
  • Configure tiers and allocate rewards
  • Monitor performance and user engagement

Clients can:

  • Participate in reward pools
  • Earn, track, and redeem rewards
  • Exchange reward value where allowed

5. Reward Cap

The maximum total reward per Client per Retailer or reward cycle is capped at €200, in line with EU Commission guidelines. Retailers are responsible for enforcing this limit. The Platform will monitor and alert for threshold breaches.

6. Data Collection and GDPR Compliance

We are committed to GDPR compliance. Key practices include:

  • Only storing users’ phone number and nickname
  • No biometric data (e.g., fingerprint) is transmitted to our servers
  • If a user disables their account, all stored data is automatically and permanently deleted
  • Retailers are considered data controllers of client data they process
  • Gamma acts as a data processor where applicable
  • Clients have the right to access, correct, delete, or export their data at any time

7. Prohibited Uses

You agree not to:

  • Misrepresent your identity or abuse referral/reward logic
  • Attempt unauthorized access to Platform components
  • Distribute malware or engage in harmful activities

8. Termination

We reserve the right to suspend or terminate access for Retailers or Clients who:

  • Breach these Terms
  • Violate local or EU laws
  • Engage in fraud or abuse of the reward system

9. Limitation of Liability

  • Retailers: Liability is limited to the amount paid in the last service purchased for use of the Retailer App
  • Clients: The platform has not any liability to the clients since the rewards are strictly promises from the retailers and not from the platform.

10. Governing Law and Dispute Resolution

These Terms are governed by EU law and the laws of the country where the user resides or operates. Users may file claims through:

  • Their local EU consumer authority
  • The European Commission’s Online Dispute Resolution platform
